These Terms apply when visiting www.medsync.me and using the Medsync Mobile App (together hereinafter referred to as “Medsync”), which is owned by HEALTHNEST, LLC (hereinafter referred to as “HEALTHNEST”).
Medsync is an application designed to help you to create your accurate health profile, find healthcare providers and healthcare facilities’ contact information and organize them into “My Care Team” or “My Facilities List.”
Once you have registered an account, you can take and store notes associated with your providers or facilities. With Medsync, you can keep your health history up to date with information such as allergies, medications, and medical or surgical problems. You can also create a health summary document and share it electronically.
Medsync is not a healthcare provider and does not provide medical diagnosis, treatment, or advice.
Medsync has no control over and does not guarantee the existence, quality, accuracy, or safety of any services, providers, or products listed by users or third parties.
When using Medsync, you agree that you will not:
If we believe or discover that you are wrongfully using Medsync, we may, at our sole discretion, take steps to stop such abuse by limiting, suspending, or terminating your user account(s) and access to our services. We may also take technical and/or legal steps to prevent further misuse.
HEALTHNEST reserves the right to refuse or terminate services to anyone for any reason at any time.
HEALTHNEST reserves the right to report any activity that we suspect violates any law or regulation to appropriate law enforcement, regulators, or third parties. In such scenarios, HEALTHNEST may access and disclose information as legally required, including but not limited to user contact details, IP address, traffic information, usage history, and posted content.
You are solely responsible for ensuring that all information provided on your profile is accurate and kept up to date.
Your password may be used only to access Medsync services. You are solely responsible for maintaining its confidentiality. You may not disclose your password to any third party and are responsible for any activity or transactions conducted under your account. If your password is compromised, you must immediately change it.
You agree to receive calls, including autodialed and/or pre-recorded message calls, from Medsync at any telephone numbers (including mobile numbers) you have provided to Medsync or that Medsync has obtained from third parties. If the number is a mobile number, you consent to receive SMS or text messages. Standard message and data rates may apply.
Medsync may contact you for purposes related to your account, use of our services, or for marketing, promotional, or informational reasons, as permitted by law.
You agree to indemnify, defend, and hold harmless HEALTHNEST and its officers, directors, members, managers, shareholders, employees, successors, and assigns from and against all losses, liabilities, claims, damages, costs (including reasonable attorney’s fees), and expenses arising out of or resulting from your use of Medsync, your violation of these Terms, or your negligence or misconduct.
Your obligation to indemnify, defend, and hold harmless HEALTHNEST shall survive termination of these Terms.
We strive to keep our services safe, secure, and reliable, but we cannot guarantee continuous operation or error-free performance. You agree that you use our services at your own risk and that they are provided “AS IS.”
To the fullest extent permitted by law, HEALTHNEST disclaims all express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
HEALTHNEST (and its affiliates, officers, employees, and agents) are not liable for any damages or losses, including loss of profits, goodwill, or reputation, or any indirect, incidental, or consequential damages resulting from:
HEALTHNEST shall not be liable for failure or deficiency in service performance due to maintenance, technical failure, or events beyond its reasonable control (including natural disasters, Internet outages, labor disputes, or war).
All content available through Medsync is for informational and educational purposes only and is not a substitute for professional medical judgment, diagnosis, or treatment.
HEALTHNEST does not recommend or endorse any specific drugs, physicians, products, or treatments. Your reliance upon any information obtained through Medsync is solely at your own risk.
HEALTHNEST is not responsible for the accuracy of any information provided by you, other users, or third parties (including healthcare providers or advertisers).
HEALTHNEST complies with all applicable privacy and data protection laws, including the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Health Information Technology for Economic and Clinical Health Act (HITECH).
HEALTHNEST maintains the confidentiality and security of any Protected Health Information (PHI) transmitted or made available through Medsync, as required by law.
These Terms of Use are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
These Terms and Conditions constitute the entire agreement between you and HEALTHNEST regarding your use of Medsync.
Nothing in these Terms creates any partnership, joint venture, agency, franchise, or employment relationship between the parties. Nothing expressed or implied herein is intended to confer any rights or remedies on any third party.
If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be severed without affecting the validity of the remaining provisions.
HEALTHNEST makes no representation that all products, services, or materials provided through Medsync are appropriate or available in all locations. Accessing Medsync from territories where its content is illegal is prohibited.
